Probate in New York: With and Without a Will
Probate is the process of distributing a person's assets after he or she passes away. If the person left behind a will, then the probate process means asking the probate court to validate the will so that assets can be distributed according to the terms of the will. If the person died without a will, then the probate court will distribute any assets to relatives according to state inheritance laws.
In a will, a person is appointed as executor or personal representative. This is the individual who has primary responsibility for carrying out the terms of the will. If there is no will, then the probate court will appoint an executor.
