Credit Counseling Requirements
The Bankruptcy Abuse Prevention and Consumer Protection Act, enacted in 2005, states that a debtor must receive a briefing from a nonprofit credit counseling agency no earlier than 180 days before filing for bankruptcy protection. This briefing can be via the Internet, by telephone or in person but must provide opportunities for available credit counseling and budget analysis.
